AN ACT concerning
Montgomery County - Sediment Control Plans

FOR the purpose of altering the authority of the soil conservation district in Montgomery
County to delegate certain functions to the Montgomery County Department of
Environmental Protection so as to provide that the soil conservation district may
delegate the functions to the Montgomery County government by a certain written
agreement; and generally relating to the authority to review and approve or reject
sediment control plans in Montgomery County.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

4-105.
(b) In Montgomery County, notwithstanding the provisions of subsection (c) of
this section and § 4-103(a)(1) of this subtitle, the soil conservation district may delegate
[to the County Department of Environmental Protection, by written agreement between
the district and the County Department of Environmental Protection,] the authority to
review and approve or reject any sediment control plans for nonagricultural construction
TO THE MONTGOMERY COUNTY GOVERNMENT BY WRITTEN AGREEMENT BETWEEN
THE DISTRICT AND THE COUNTY GOVERNMENT DEPARTMENT AUTHORIZED BY
COUNTY LAW OR REGULATION TO PERFORM THOSE FUNCTIONS.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1997.
