(2) LIMIT THE PROVISIONS OF § 10-104 OF THIS SUBTITLE CONCERNING
THE ADMISSIBILITY OF A MEDICAL, DENTAL, HOSPITAL, OR OTHER HEALTH CARE
WRITING OR RECORD: OR
(3) LIMIT THE RIGHT OF A PARTY TO:
(I) REQUEST A SUMMONS TO COMPEL THE ATTENDANCE OF A
WITNESS:
(II) EXAMINE A WITNESS WHO APPEARS AT TRIAL; OR
(III) ENGAGE IN DISCOVERY AS PROVIDED UNDER THE MARYLAND
RULES.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed
only prospectively and may not be applied or interpreted to have any effect on or
application to any case filed before the effective date of this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.

AN ACT concerning
Health Care Medical, Dental, or Hospital Records and Writings — Admissibility
FOR the purpose of making certain health care records and writings admissible in certain
civil trials in the District Court without presenting certain testimony; making certain
medical, dental, hospital, and other health care and hospital records and writings
admissible in certain civil trials in the circuit courts without presenting certain
testimony; requiring certain procedures; altering certain time periods, before the
beginning of the trial, bv which certain parties shall file and serve certain notices:
clarifying language; providing for the application of this Act; and generally relating
to the admissibility of health care records and writings to prove certain matters in
certain civil trials.
