CHAPTER 422
(House Bill 259)

AN ACT concerning

Howard County - Alcoholic Beverages
(Alcohol Awareness)

Ho. Co. 5-97

FOR the purpose of including Howard County with the jurisdiction that requires that an
alcoholic beverages licensee or a person employed in a supervisory capacity shall be
certified by an approved alcohol awareness program and shall be present during the
hours in which alcohol is sold; making a certain exception: clarifying language; and
generally relating to alcoholic beverages in Howard County.

BY repealing and reenacting, with amendments,
Article 2B - Alcoholic Beverages
Section 13-101(c)(2)
Annotated Code of Maryland
(1996 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

13-101.

(c) (2) (i) This paragraph applies only in THE FOLLOWING JURISDICTIONS:

1. HOWARD COUNTY; AND

2. Montgomery County.

(ii) The licensee or a person who is employed in a supervisory capacity
designated by the licensee shall :

1. SHALL be certified by an approved alcohol awareness

program; and shall

2. EXCEPT AS OTHERWISE PROVIDED IN SUBPARAGRAPH (III)
OF THIS PARAGRAPH,
be present during the hours in which alcohol may be sold.

(III) I. IN HOWARD COUNTY, THE PERSON CERTIFIED BY AN
APPROVED ALCOHOL AWARENESS PROGRAM MAY BE ABSENT FROM THE LICENSED
PREMISES FOR A BONA FIDE PERSONAL OR BUSINESS REASON OR AN EMERGENCY, IF
THE ABSENCE LASTS FOR NO MORE THAN 2 HOURS.

2. THE BOARD OF LICENSE COMMISSIONERS SHALL REQUIRE
THE LICENSEE TO KEEP A LOG BOOK ON THE LICENSED PREMISES THAT CONTAINS
