SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 27 - Crimes and Punishments
61.
Every person who wilfully and maliciously interferes with, injures, destroys or
tampers with, or who wilfully sets on foot, instigates, engages in or in any way furthers any
act by which any horse used for the purposes of racing, breeding or competitive exhibition
of skill, breed or stamina, is interfered with, injured, destroyed or tampered with, or any
act tending to produce such interference, injury, destruction or tampering, whether such
horse be the property of himself or another, shall be deemed guilty of a felony, punishable
by imprisonment [in the Maryland Penitentiary] for a term of not less than one year nor
more than three years.
75.
(a) (1) In this section the following terms have the meanings indicated.
(2) (i) "State postconviction review process" means the initial
adjudication of a postconviction petition filed under § 645A(a)(2)(i) of this article,
including any appellate review of the postconviction proceeding.
(ii) "State postconviction review process" does not include:
