(IV) INCLUDE THE CRITERIA THAT ARE THE BASIS FOR (ACCEPTING
OR REJECTING THE PLAN.
(2) THE DATE FOR SUBMISSION OF THE PLAN SHOULD PROVIDE
SUFFICIENT TIME TO DEVELOP A COMPREHENSIVE PLAN THAT:
IS NOT LESS THAN 30 DAYS; AND
(II) IS NOT LATER THAN 5 MONTHS AFTER THE DATE OF THE
NOTICE, UNLESS THE TIME LIMIT IS WAIVED BY THE AGENCY HEAD FOR A PERIOD
NOT TO EXCEED 30 DAYS:
(C) FOR PURPOSES OF DEVELOPING A PLAN UNDER SUBSECTION (B) OF THIS
SECTION, THE FOLLOWING CONDITIONS SHALL APPLY:
(1) THE AGENCY SHALL PROVIDE THE SERVICE UNIT WITH
REASONABLE TECHNICAL ASSISTANCE TO DEVELOP THE PLAN;
(2) THE PLAN SHALL PROVIDE FOR PERFORMANCE MEASUREMENTS
AND BUDGET REQUIREMENTS;
(3) THE PLAN SHALL PROVIDE FOR ANNUAL AUDITS OF BOTH BUDGET
AND PERFORMANCE MEASUREMENTS;
(4) THE PLAN SHALL SPECIFY A TERM OF SERVICE NOT TO EXCEED 3
YEARS FROM THE DATE OF ITS APPROVAL BY THE HEAD OF THE AGENCY;
(5) THE PLAN MAY PROVIDE INCENTIVES FOR EXCEEDING PLAN
GOALS; AND
(6) NEITHER THE PLAN NOR ITS IMPLEMENTATION MAY DISCRIMINATE
AMONG EMPLOYEES ON THE BASIS OF RACE, SEX, RELIGIOUS BELIEFS, NATIONAL
ORIGIN, OR PHYSICAL OR MENTAL DISABILITY.
(D) THE PLAN SHALL BE SUBMITTED TO THE HEAD OF THE AGENCY.
(E) THE HEAD OF THE AGENCY:
(1) MAY CONDUCT DISCUSSIONS WITH THE SERVICE UNIT REGARDING
THE PLAN;
(2) SHALL ASCERTAIN THAT THE PLAN REFLECTS THE VIEWS OF A
MAJORITY OF THE EMPLOYEES OF THE SERVICE UNIT; AND
(3) SHALL APPROVE OR REJECT THE PLAN IN WRITING TO THE SERVICE
UNIT.
(F) THE TARGETED SERVICE SHALL BE SUBJECT TO COMPETITIVE
RE-ENGINEERING UNDER § 18-105 OF THIS TITLE IF:
(1) THE SERVICE UNIT FAILS TO COMPLY WITH THE PLAN;
(2) THE SERVICE UNIT FAILS TO SUBMIT A PLAN; OR
(3) THE HEAD OF THE AGENCY REJECTS THE PLAN.
