PARRIS N. GLENDENING, Governor Ch. 372

3014.

(A) IN THIS SECTION, "DISTRIBUTE" MEANS THE ACTUAL, CONSTRUCTIVE. OR
ATTEMPTED TRANSFER EXCHANGE OR. DELIVERING FROM ONE PERSON TO ANOTHER
WITH OR WITHOUT REMUNERATION WHETHER OR NOT THERE EXISTS AN AGENCY
RELATIONSHIP.

[(a)](B) [No person may] A PERSON MAY NOT distribute, or possess with intent to
distribute, to any other person any of the substances enumerated in § 301 of this article if such
distribution is with the intent to induce unlawful inhaling of the substance or is with the
knowledge that the other person will unlawfully inhale the substance.

[(b)](C) [No person may] A PERSON MAY NOT instruct another person in the
practice of unlawful inhaling as defined in § 301 of this article.

(D) A PERSON MAY NOT DISTRIBUTE A BUTANE CANISTER TO A MINOR.

[(c)](E) A person who violates any provision of this section is guilty of a
misdemeanor and, upon conviction, is subject to a fine not exceeding [$500] $1,000, or
imprisonment not exceeding 18 months, or both.

[(d) A person found guilty of a second or subsequent violation of any provision of this
section is subject to a fine not exceeding $1,000, or imprisonment not exceeding 3 years, or
both. I

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.

(Senate Bill 587)

AN ACT concerning

Manslaughter by Motor Vehicle and Homicide by Motor Vehicle or Vessel While
Intoxicated, Intoxicated Per Se, or Under the Influence - Penalties

FOR the purpose of making manslaughter by motor vehicle a felony and making it a
felony to cause the death of another as a result of certain negligent driving,
operation, or control of a motor vehicle or vessel while intoxicated or intoxicated
per se or under the influence of alcohol, drugs, or a controlled dangerous substance;
providing for jurisdiction of the offenses under this Act; and generally relating to
manslaughter by vehicle and homicide by motor vehicle or vessel while intoxicated,
intoxicated per se, or under the influence of alcohol, drugs, or a controlled dangerous
substance.

BY repealing and reenacting, with amendments,
Article 27 - Crimes and Punishments
