SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article—Family Law
5-701.
(p) (1) "Neglect— means the leaving of a child unattended or other failure to
give proper care and attention to a child by any parent or other person who has
permanent or temporary care or custody or responsibility for supervision of the child
under circumstances that indicate:
[(1)] (I) that the child's health or welfare is harmed or placed at substantial
risk of harm; or
[(2)} (II) mental injury to the child or a substantial risk of mental injury.
(2) (I) EXCEPT AS PROVIDED UNDER SUBPARAGRAPH (II) OF THIS
PARAGRAPH, "NEGLECT" INCLUDES THE USE OF A CONTROLLED DANGEROUS
SUBSTANCE, AS DEFINED IN ARTICLE 27, § 277 OF THE CODE, BY A WOMAN
RESULTING IN:
1. AN INFANT'S ADDICTION TO OR DEPENDENCE ON A
CONTROLLED DANGEROUS SUBSTANCE; OR
2. THE PRESENCE OF A CONTROLLED DANGEROUS
SUBSTANCE IN THE INFANT'S BLOOD AS EVIDENCED BY A TOXICOLOGY OR OTHER
APPROPRIATE CHEMICAL TEST OF THE INFANT.
