SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

33.

(a) A person who commits burglary in the first, second, or third degree and who
then and there opens or attempts to open any vault, safe, or other secure repository by
the use of [an explosive] A DESTRUCTIVE DEVICE, AS DEFINED IN § 139A OF THIS
ARTICLE, is guilty of the felony of burglary with explosives and on conviction is subject to
imprisonment for not more than 20 years.

(b) A sentence that is imposed for a violation of this section may be imposed
separate from and consecutive to or concurrent with a sentence for any other offense
based on the act or acts establishing the violation.
