AN ACT concerning
State-Personnel— Disability Retirement Benefits - Employees of Boards of Education -
Offset for Workers' Compensation Benefits - Exclusion
FOR the purpose of providing that a retiree of the Employees' Pension System or the
Employees' Retirement System who receives a disability retirement benefit as a
former employee of a county board of education or the Board of School
Commissioners of Baltimore City or a designated beneficiary of the retiree is not
subject to an offset of those benefits under a certain provision of the Code due to
receipt of workers' compensation benefits; providing that the retiree of the
Employees' Pension System or the Employees' Retirement System or designated
beneficiary is subject to an offset of the workers' compensation benefits under a
certain provision of the Code; and generally relating to the offset of benefits of a
retiree of the Employees' Pension System or the Employees' Retirement System who
receives a disability retirement benefit as a former employee of a county board of
education or the Board of School Commissioners of Baltimore City.

(a) (1) [If] EXCEPT FOR BENEFITS SUBJECT TO AN OFFSET UNDER § 29-118 OF
THE STATE PERSONNEL AND PENSIONS ARTICLE, IF a statute, charter, ordinance,
resolution, regulation, or policy, regardless of whether part of a pension system, provides a
benefit to a covered employee of a governmental unit or a quasi-public corporation that is
subject to this title under § 9-201(2) of this title or, in case of death, to the dependents of the
covered employee, payment of the benefit by the employer satisfies, to the extent of the
payment, the liability of the employer and the subsequent injury fund for payment of benefits
under this title.
