(a) A person who willfully or knowingly violates this title is guilty of a
misdemeanor and, on conviction, is subject to a fine not exceeding [$5,000] $10,000 or
imprisonment not exceeding [1 year] 2 YEARS or both.

(b) Each associate, employee, manager, or partner who participates in or consents
to a violation of this title is guilty of a misdemeanor and, on conviction, is subject to a fine
not exceeding $5,000 or imprisonment not exceeding 1 year or both.

(c) Each violation of this title is a separate offense.

SECTION 2. AND BE IT FURTHER ENACTED, That § 12-209(a)(2)(vi) of the
Business Regulation Article, as enacted by this Act, shall be construed only prospectively
and may not be applied or interpreted to have any effect on or application to licensees or
license applicants for employees hired before the effective date of this Act.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1997.

AN ACT concerning

Franciscan Center Loan of 1994

FOR the purpose of amending Chapter 198 of the Acts of the General Assembly of 1994,
the Franciscan Center Loan of 1994, as amended by Chapter 452 of the Acts of the
General Assembly of 1996; altering the address of the project for which the
proceeds of the bonds will be used; and extending the time by which the grantee
shall provide a matching fund.

BY repealing and reenacting, with amendments,

Chapter 198 of the Acts of the General Assembly of 1994, as amended by Chapter
452 of the Acts of the General Assembly of 1996
