UNLESS THE BOARD FINDS THAT THE FAILURE OR REFUSAL WAS BEYOND THE
CONTROL OF THE CERTIFIED NURSING ASSISTANT.

(D) THE BOARD SHALL PAY THE COST OF ANY EXAMINATION MADE IN
ACCORDANCE WITH THE PROVISION
S OF THIS SECTION.

8-6A-17.

IF THE BOARD DETERMINES THAT THE INFORMATION CONTAINED IN A
RECORD CONCERNS POSSIBLE CRIMINAL ACTIVITY OF A CERTIFIED NURSING
ASSISTANT, THE BOARD SHALL DISCLOSE THE INFORMATION TO A LAW
ENFORCEMENT OR PROSECUTORIAL OFFICIAL.

(f) An unlicensed individual who acts under § 8-102(b)(3) of this title may use
the
word "nursing" together with another word to describe the occupation of the
individual, as in [phrases] A PHRASE such as "nursing aide" [and "nursing assistant"].

SECTION 2. AND BE IT FURTHER ENACTED, That §§ 8-6A-02 and 8-6A-03
of the Health
-Occupations Article as enacted by Section 1 of this Act shall take effect
October 1, 1999.

(A) AS OF JANUARY 1, 2000, THE BOARD SHALL REGULATE NURSING
ASSISTANTS WHO PRACTICE IN THE STATE SHALL BE REGULATED.

(B) THE BOARD DEPARTMENT SHALL ESTABLISH AN ADVISORY COMMITTEE
TO MAKE RECOMMENDATIONS TO THE BOARD RELATING TO:

(1) THE EDUCATION AND TRAINING REQUIREMENTS FOR NURSING
ASSISTANTS WHO PRACTICE IN THE STATE;

(2) THE CLINICAL AND ADMINISTRATIVE PROCEDURES FOR THE
REGULATION OF NURSING ASSISTANTS; AND

(3) A PLAN FOR THE MOBILITY OF NURSING ASSISTANTS BETWEEN
VARIOUS PRACTICE SETTINGS.

(C) THE ADVISORY COMMITTEE SHALL INCLUDE REPRESENTATIVES OF:

(1) NURSING ASSISTANTS;

(2) THE AFFECTED INDUSTRIES, INCLUDING HOSPITALS, LONG-TERM
CARE FACILITIES, AND ASSISTED LIVING FACILITIES;

(3) THE DEPARTMENT BOARD;

(4) THE MARYLAND HIGHER EDUCATION COMMISSION;

(5) ORGANIZATIONS THAT REPRESENT NURSING ASSISTANTS IN THEIR
RELATIONS WITH THEIR EMPLOYERS; AND

(6) CONSUMERS OF THE SERVICES PROVIDED BY NURSING ASSISTANTS.
