AN ACT concerning

Needle Exchange Program - Repeal of Sunset

FOR the purpose of repealing the termination of the law relating to the AIDS Prevention
Sterile Needle and Syringe Exchange Pilot Program; requiring the State
Department of Health and Mental Hygiene and the Baltimore City Health
Department to jointly report to the Governor and the General Assembly on or
before a certain date; and generally relating to the repeal of the termination
provision on the AIDS Prevention Sterile Needle and Syringe Exchange Pilot
Program.

BY repealing and reenacting, with amendments,

Chapter 360 of the Acts of the General Assembly of 1994, as amended by Chapter

3 of the Acts of the General Assembly of 1995
Section 2

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety, has
been passed by a yea and nay vote supported by three-fifths of all the members elected to
each of the two Houses of the General Assembly, and shall take effect from the date it is
enacted. [It shall remain effective for a period of 3 years and, at the end of 3 years from
the date of enactment May 31, 1997, with no further action required by the General
Assembly, this Act shall be abrogated and of no further force and effect.]

SECTION 2. AND BE IT FURTHER ENACTED, That the Department of
Health and Mental Hygiene and the Baltimore City Health Department shall jointly
report to the Governor and, in accordance with § 2-1312 of the State Government
Article, the General Assembly on or before January 31 of each year on the status of the
AIDS Prevention Sterile Needle and Syringe Exchange Pilot Program, including the
sources of funding for the program, the cost-savings of the program, the number of
clients served by the program, the success of the program in referring clients for drug
treatment, the drug use behavior of clients before enrollment in the program and during
enrollment in the program, and the HIV seroconversion rate among clients participating
in the program.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1997.
