AN ACT concerning

State Board for Professional Land Surveyors - Qualifications for Firm Permit

FOR the purpose of allowing a professional land surveyor or a licensed property line
surveyor to practice through a limited liability company; allowing a limited liability
company to offer land surveying and property line surveying services; specifying
certain circumstances when a person may operate a certain business as a limited
liability company; prohibiting an individual from practicing land surveying or
property line surveying under certain circumstances: and generally relating to the
practice of land surveying and property line surveying.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Business Occupations and Professions

15-401.

(a) (1) Subject to the provisions of this section, a professional land surveyor
may practice land surveying for others through:

(i) a corporation as an officer, employee, or agent of the corporation;

[or]

(ii) a partnership as a partner, employee, or agent of the partnership;

OR

(III) A LIMITED LIABILITY COMPANY AS A MEMBER, EMPLOYEE, OR
AGENT OF THE LIMITED LIABILITY COMPANY.

(2) Subject to the provisions of this section, a licensed property line surveyor
may practice property line surveying through:

(i) a corporation as an officer, employee, or agent of the corporation;

[or]

(ii) a partnership as a partner, employee, or agent of the partnership;

OR

(III) A LIMITED LIABILITY COMPANY AS A MEMBER, EMPLOYEE OR
AGENT OF THE LIMITED LIABILITY COMPANY.
