AN ACT concerning

Pensions - Arbitration of Claims - Upgrades of Computer Systems

FOR the purpose of authorizing the Board of Trustees of the State Retirement and
Pension System to submit to arbitration any claims arising in connection with the
implementation and operation of an upgrade to the State Retirement Agency's data
processing or electronic data management system; and providing for the termination
of this Act.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Personnel and Pensions

21-108.

(a) The responsibility for the management, general administration, and proper
operation of the several systems is vested in the Board of Trustees.

(b) In addition to the Investment Committee established under § 21-114 of this
subtitle, the Board of Trustees may establish other committees.

(c) Subject to § 21-123 of this subtitle, the Board of Trustees shall have full power
to invest the assets of the several systems.

(D) THE BOARD OF TRUSTEES MAY SUBMIT TO ARBITRATION ANY CLAIMS
ARISING IN CONNECTION WITH THE IMPLEMENTATION AND OPERATION OF AN
UPGRADE TO THE STATE RETIREMENT AGENCY'S DATA PROCESSING OR
ELECTRONIC DATA MANAGEMENT SYSTEM

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1997. It shall remain effective for a period of 5 years, and at the end of June 30,
2002, with no further action required by the General Assembly, this Act shall be
abrogated and of no further force and effect.
