(A) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, AN INSURER (1) HAS BEEN INSURED BY THE FUND; (2) HAS NOT HAD A MOVING TRAFFIC VIOLATION; AND (3) HAS NOT HAD A CHARGEABLE TRAFFIC ACCIDENT.
