"BOARD" MEANS THE BOARD OF DIRECTORS OF THE POOL ESTABLISHED
UNDER § 15-1216 OF THIS SUBTITLE.

Defined term: "Pool" § 15-1201

(C) CARRIER.

"CARRIER" MEANS A PERSON THAT:

(1) OFFERS HEALTH BENEFIT PLANS IN THE STATE COVERING ELIGIBLE
EMPLOYEES OF SMALL EMPLOYERS; AND

(2) IS:

(I) AN AUTHORIZED INSURER THAT PROVIDES HEALTH
INSURANCE IN THE STATE;

(II) A NONPROFIT HEALTH SERVICE PLAN THAT IS LICENSED TO
OPERATE IN THE STATE;

(III) A HEALTH MAINTENANCE ORGANIZATION THAT IS LICENSED
TO OPERATE IN THE STATE; OR

(IV) ANY OTHER PERSON OR ORGANIZATION THAT PROVIDES
HEALTH BENEFIT PLANS SUBJECT TO STATE INSURANCE REGULATION.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 48A, § 698(d).

In item (1) of this subsection, the reference to offering health benefit plans "in
the State" is added to clarify that the defined term "carrier" only applies to
persons who offer health benefit plans in the State.

In item (2)(i) of this subsection, the defined term "authorized insurer" is
substituted for the former reference to an "insurer that holds a certificate of
authority in the State" for brevity and consistency with the terminology used
throughout this article.
