(2) THE ATTENDING PHYSICIAN OR CERTIFIED NURSE MIDWIFE OF THE
MOTHER, OR DESIGNEE OF THE ATTENDING PHYSICIAN OR CERTIFIED NURSE
MIDWIFE, SHALL PROVIDE NOTICE TO THE MOTHER OF THE PROVISIONS OF
PARAGRAPH (1) OF THIS SUBSECTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, §§ 354F, 470H, and 477-I.

In subsection (a) of this section, the reference to a "nonprofit health service
plan" is substituted for the former reference to a "nonprofit health insurer"
for clarity and consistency with the terminology used throughout this article.

Also in subsection (a) of this section, the former references to issuing or
delivering a policy "to any person" in the State are deleted as implicit.

Also in subsection (a) of this section, the former references to hospitalization
benefits for "the cost of hospitalization for" childbirth are deleted as
surplusage.

15-812. INPATIENT HOSPITALIZATION COVERAGE FOR MOTHERS AND NEWBORN
CHILDREN.

(A) "ATTENDING PROVIDER" DEFINED.

IN THIS SECTION, "ATTENDING PROVIDER" MEANS AN OBSTETRICIAN,
PEDIATRICIAN, OTHER PHYSICIAN, CERTIFIED NURSE MIDWIFE, OR PEDIATRIC
NURSE PRACTITIONER ATTENDING A MOTHER OR NEWBORN CHILD.

(B) SCOPE OF SECTION.
THIS SECTION APPLIES TO:

(1) INSURERS AND NONPROFIT HEALTH SERVICE PLANS THAT PROVIDE
INPATIENT HOSPITALIZATION COVERAGE TO INDIVIDUALS OR GROUPS ON AN
EXPENSE-INCURRED BASIS UNDER HEALTH INSURANCE POLICIES OR CONTRACTS
THAT ARE ISSUED OR DELIVERED IN THE STATE; AND

(2) HEALTH MAINTENANCE ORGANIZATIONS THAT PROVIDE
INPATIENT HOSPITALIZATION COVERAGE TO INDIVIDUALS OR GROUPS UNDER
CONTRACTS THAT ARE ISSUED OR DELIVERED IN THE STATE.

(C) MINIMUM LENGTH OF INPATIENT HOSPITALIZATION CARE.

AN ENTITY SUBJECT TO THIS SECTION SHALL PROVIDE COVERAGE FOR THE
COST OF INPATIENT HOSPITALIZATION SERVICES FOR A MOTHER AND NEWBORN
CHILD FOR A MINIMUM OF:

(1) 48 HOURS OF INPATIENT HOSPITALIZATION CARE AFTER AN
UNCOMPLICATED VAGINAL DELIVERY; AND
