1997 LAWS OF MARYLAND

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 490L(a) through (d).

In subsection (d)(1) of this section, the reference to a nonprofit health
"service" plan is added for clarity and consistency with the terminology used
throughout this article.

Also in subsection (d)(1) of this section, the reference to a policy or contract
that is issued or delivered to an "individual" is added to clarify the
applicability of subsection (d) of this section.

Also in subsection (d)(1) of this section, the defined term "insurer" is
substituted for the former reference to an "insurance company" for
consistency with the terminology used throughout this article.

Former Art. 48A, § 490L(e), which provided that the provisions of former Art.
48A, §§ 354D, 470E, and 477E did not limit the amount of reimbursement
under former § 490L, is deleted as obsolete because former §§ 354D, 470E,
and 477E were repealed by Chapter 2 of the Acts of 1994, effective February
28, 1994.

15-806. CHOICE OF PHARMACY FOR FILLING PRESCRIPTIONS.

A NONPROFIT HEALTH SERVICE PLAN THAT PROVIDES PHARMACEUTICAL
SERVICES SHALL ALLOW A SUBSCRIBER, MEMBER, OR BENEFICIARY TO FILL
PRESCRIPTIONS AT THE PHARMACY OF THE SUBSCRIBER'S, MEMBER'S, OR
BENEFICIARY'S CHOICE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 354A(b).

The reference to a nonprofit health "service" plan is added for clarity and
consistency with the terminology used throughout this article.

15-807. COVERAGE FOR MEDICAL FOODS AND MODIFIED FOOD PRODUCTS.
(A) DEFINITIONS.

(1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS

INDICATED.

(2) (I) "INHERITED METABOLIC DISEASE" MEANS A DISEASE CAUSED
BY AN INHERITED ABNORMALITY OF BODY CHEMISTRY.

(II) "INHERITED METABOLIC DISEASE" INCLUDES A DISEASE FOR
WHICH THE STATE SCREENS NEWBORN BABIES.

(3) (I) "LOW PROTEIN MODIFIED FOOD PRODUCT" MEANS A FOOD
PRODUCT THAT IS:
