AMENDMENTS TO SENATE BILL 160/HOUSE BILL 160

Amendment No. 1:
On page 64, beginning in line 35, add the following words "Provided that funds may
be transferred pursuant to an approved budget amendment to the State Department of
Education, Subcabinet Fund for the purpose of developing a broad range of services to
assist in returning children with special needs from out of state placements to Maryland,
to prevent out of state placements of children with special needs, to prevent unnecessary
out of home placements within Maryland, and to implement a statewide system of
interagency budgeting and funding."
Amendment No. 2:
On page 68, beginning in line 28, add the following words "Provided that funds may
be transferred pursuant to an approved budget amendment to the State Department of
Education. Subcabinet Fund for the purpose of developing a broad range of services to
assist in returning children with special needs from out of state placements to Maryland,
to prevent out of state placements of children with special needs, to prevent unnecessary
out of home placements within Maryland, and to implement a statewide system of
interagency budgeting and funding."
Amendment No. 3:
On page 72, beginning in line 21, add the following words "Provided that funds may
bo transferred pursuant to an approved budget amendment to the State Department of
Education, Subcabinet Fund for the purpose of developing a broad range of services to
assist in returning children with special needs from out of state placements to Maryland,
to prevent out of state placements of children with special needs, to prevent unnecessary
out of home placements within Maryland, and to implement a statewide system of
interagency budgeting and funding. For each child returned or diverted in fiscal year 1996
or fiscal year 1997, the funds transferred shall be equal to the general fund portion of the
per diem amount of what it would have cost to maintain the child in an out of state
placement. Funds shall not be transferred if an in state placement of a child qualifies for
federal Medical Assistance funding."
Amendment No. 4:
Beginning on page 76, in line 27, and ending on page 77 in line 5, strike the words
", provided" through "Education." in its entirety.
Amendment No. 5:
On page 77, beginning in line 8, add the following words "Provided that funds may
be transferred pursuant to an approved budget amendment to the State Department of
Education. Subcabinet Fund for the purpose of developing a broad range of services to
assist in returning children with special needs from out of state placements to Maryland,
