by the Board of Public Works that the amendment is essential to maintaining public
safety, health or welfare, including protecting the environment or economic welfare of the
State.
SECTION 28. AND BE IT FURTHER ENACTED. That no funds, including
general funds to match a federal grant, may be expended before the agency receives the
federal grant and the supporting documentation evidencing the receipt of the grant is
certified by the Secretary of Budget and Fiscal Planning unless the State is required to
expend State funds to show the State's support for the program before receiving -the
federal grant. Further provided, that in the event that grant funds become unavailable any
unexpended general funds associated with the grant project shall be reverted to the
Treasury except where the Board of Public Works certifies that there arc extraordinary or
unusual circumstances that preclude the reversion of the funds. Any equipment
purchased with grant funds or matching State funds, where the grant is terminated, shall
bo transferred to another agency that can document a need for the equipment in
accordance with State law, rules and procedures for the disposal of surplus State
property, unless the equipment can be utilized for programs funded by other grants.
SECTION 29 28. AND BE IT FURTHER ENACTED. That:
(1) For Fiscal Year 1997 a statewide average turnover expectancy factor of 29%
2.5% shall be established for contractual positions, excluding contractual teaching faculty,
work study, research, auxiliary and hospital programs in institutions of higher education;
(2) To recognize savings resulting from operation of this provision, funds
appropriated in this budget for contractual salaries (subobjects a02 and b20) and fringe
benefits (subobjects b13, b14 and b17) shall be reduced as provided in this section;
(3) The Governor shall (a) develop a schedule for allocating this reduction to the
programs of the executive branch which do not reflect the turnover expectancy factor
established under this section and (b) take such actions as may be required to implement
the reduction under Section 7-213 of the State Finance and Procurement Article; and
(4) Aggregate reductions under this section shall equal at least the amounts
indicated for the budgetary fund types listed:

Special and Current Unrestricted $500,000 $600,000.
SECTION 30 29. AND BE IT FURTHER ENACTED. That:
(1) It is the intent of the General Assembly that the federal fund revenue
estimates upon which appropriations in this budget are based shall reflect reasonable
judgments based on the information available at the time the budget is enacted;
(2) In order to implement this intent, it is necessary to downwardly adjust
estimates of attainment from certain federal programs in order to reflect federal
