achieve the goals of increasing student
achievement and correcting management
deficiencies in the BCPS. The Partnership
agreement shall be structured to: promote
collaboration; articulate reasonable
expectations; create accountability; allow
for independent monitoring; maximize
limited resources; facilitate reform; focus on
key areas; and fulfill the BCPS' educational
mission. Every aspect of the Partnership
agreement shall be student-centered.
During the term of the partnership the State
will continue to provide a level of
non-mandated funding as recommended by
the Partnership, requested by the Governor.

(b) The State, Baltimore City, and other
litigants shall request that Judge Joseph
H.H. Kaplan incorporate the Partnership
agreement in a consent decree entered in
Baltimore City Circuit Court placing the
pending cases filed by the ACLU plaintiffs
and Baltimore City on an inactive status.
The State and City shall also request that
Judge Marvin Gar bis, who oversees the suit
filed in the U.S. District Court by the
Maryland Disabilities Law Center, enter an
order parallel to that issued by Baltimore
City Circuit Court; and
(c) The funds shall be released after the
budget committees receive a request from
the Partnership for release of the funds
accompanied by a report on the
establishment of the Partnership and the
progress in implementing the Partnership
goals. The budget committees shall have 45
days from the date the report is received for
