The State Department of Education shall not
expend funds for any job or position of
employment approved in this budget in
excess of 1,434 1,485 positions, including
full-time equivalent special payments,
contractual positions (defined as the
quotient of the sum of the days worked by
all such employees in the fiscal year divided
by 245) of the total authorized amount
established in the budget for fiscal 1997.
The State Superintendent of Schools shall
utilize prerogatives under the Education
Article, Section 2-103 to implement this
provision, provided, however, that any
authorized position to be filled above the
ceiling, including all 1,434 1,485 full-time
equivalent positions, as detailed above, is
approved by the Board of Public Works and
counted against the limitation imposed by
the General Assembly. The fiscal 1997
budget shall be subject to the State Finance
and Procurement Article, Section 7-236 and
the limitation imposed by the General
Assembly.
