Subsection (c)(1) of this section is new language added to state expressly that
which only was implied in the former law, i.e., that to renew a license the
licensee must otherwise be entitled to the license.

Subsection (d) of this section is standard language added to state expressly
that which only was implied in the former law, i.e., the Commissioner has a
duty to renew the license of a qualified licensee.

In the introductory language of subsection (c) of this section, the former
reference to certificates "not previously revoked or suspended" is deleted as
unnecessary. A certificate or license that has been suspended or revoked is not
in effect and therefore cannot be renewed.

In subsection (c)(2) of this section, the former reference to an application that
contains "such information prescribed by [the Commissioner]" is deleted as
included in the requirement that the licensee file a renewal application "on
the form that the Commissioner provides".

26-207. SERVICE OF PROCESS.

(A)     APPOINTMENT OF COMMISSIONER AS ATTORNEY.

(1)     EACH LICENSEE MUST APPOINT THE COMMISSIONER AS ATTORNEY
FOR SERVICE OF PROCESS ISSUED AGAINST THE LICENSEE UNDER THIS TITLE.

(2)     THE APPOINTMENT OF THE COMMISSIONER MUST:

(I)      BE IN WRITING; AND

(II)    STATE THAT THE LICENSEE AGREES THAT:

1.       LAWFUL PROCESS AGAINST THE LICENSEE THAT IS
SERVED ON THE COMMISSIONER, OR IN THE COMMISSIONER'S ABSENCE, ON AN
EMPLOYEE IN CHARGE OF THE OFFICE OF THE COMMISSIONER, HAS THE SAME
EFFECT AS IF SERVED ON THE LICENSEE; AND

2.       THE AUTHORITY OF THE COMMISSIONER TO ACT AS
ATTORNEY FOR SERVICE OF PROCESS CONTINUES IN FORCE AS LONG AS ANY
LIABILITY REMAINS OUTSTANDING AGAINST THE LICENSEE UNDER THIS TITLE IN
THE STATE.

(3)     A CERTIFIED CERTIFICATE OF THE APPOINTMENT SHALL BE FILED
WITH THE COMMISSIONER.

(B)     PROCEDURE.

(1) WHEN LAWFUL PROCESS AGAINST A LICENSEE UNDER THIS TITLE IS
SERVED ON THE COMMISSIONER, THREE COPIES OF THE PROCESS SHALL BE
FURNISHED TO THE COMMISSIONER.
