25-110. FINES AND PENALTIES.

A RISK RETENTION GROUP THAT VIOLATES ANY PROVISION OF THIS SUBTITLE
IS SUBJECT TO FINES AND PENALTIES APPLICABLE TO LICENSED INSURERS
GENERALLY, INCLUDING REVOCATION OF ITS LICENSE AND THE RIGHT TO DO
BUSINESS IN THE STATE.

REVISOR'S NOTE: This section formerly was Art. 48A, § 627.

The only changes are in style.

Defined terms: "Insurer" § 1-101

"Risk retention group" § 25-101

25-111. SHORT TITLE.

THIS SUBTITLE IS THE MARYLAND RISK RETENTION ACT.

REVISOR'S NOTE: This section is new language added to provide a convenient
cross-reference to this subtitle.

SUBTITLE 2. AGRICULTURAL GROUP POLICIES.
25-201. PURPOSE OF SUBTITLE.

THE PURPOSE OF THIS SUBTITLE IS TO ALLOW EMPLOYEES OF SMALL FARMS
TO BE ENTITLED TO PROTECTION UNDER THE MARYLAND WORKERS'
COMPENSATION ACT.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 48A, § 565, as it described the
purpose of former § 565.

25-202. EMPLOYERS SUBJECT TO SUBTITLE.

THIS SUBTITLE APPLIES TO THE FOLLOWING EMPLOYERS OF AGRICULTURAL
LABOR, SOME OR ALL OF WHOM MAY NOT BE REQUIRED TO CARRY WORKERS'
COMPENSATION INSURANCE:

(1)      MEMBERS OF A NONPROFIT AGRICULTURAL ASSOCIATION; AND

(2)      MEMBERS OF OR STOCKHOLDERS IN A NONPROFIT COOPERATIVE
AGRICULTURAL MARKETING ASSOCIATION OF PRODUCERS.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 48A, § 565, as it described
specified employers of agricultural labor.

25-203. GROUP WORKERS' COMPENSATION POLICY AUTHORIZED.

EMPLOYERS SUBJECT TO THIS SUBTITLE MAY BE INSURED UNDER A GROUP
WORKERS' COMPENSATION INSURANCE POLICY UNDER THE CONDITIONS THAT THE
COMMISSIONER SETS.
