(1) "Person" includes the State, any county, municipal corporation, or other
political subdivision of the State, or any of their units, an individual, business association,
corporation, business trust, estate, trust, partnership, association, two or more persons
having a joint or common interest, or any other legal or commercial entity.
(M) "PERSONAL PROPERTY" DOES NOT INCLUDE A GIFT CERTIFICATE.
[(m)] (N) "Utility" means any person who owns or operates in the State, for public
use, any plant, equipment, property, franchise, or license for the transmission of
communications, for the production, storage, transmission, sale, delivery, or furnishing of
electricity, water, steam, or gas, or for the transportation of persons or property.
[(n)](O) "Service charge" means any type of deduction or charge made by a
holder on property presumed abandoned under this title.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed
retroactively and shall be applied and interpreted to affect any gift certificates that were
determined abandoned under the Maryland Uniform Disposition of Property Act on or
after November 1, 1995. The Comptroller of the Treasury shall return to a person, any
money collected on or after November 1, 1995 for gift certificates that were determined
abandoned property under the Maryland Uniform Disposition of Property Act.
SECTION 3. 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1996.

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 748.
This bill prohibits a person from willfully manufacturing, producing, displaying,
advertising, distributing, selling, or possessing items or services that the person knows are
bearing or identified by a counterfeit mark by establishing the crime of trademark
counterfeiting. This bill also establishes penalties for trademark counterfeiting.
Senate Bill 410, which was passed by the General Assembly and signed by me on this
date, accomplishes the same purpose. Therefore, it is not necessary for me to sign House
Bill 748.
