S.B. 364

2-1222.

A person is guilty of a misdemeanor and on conviction is subject to a fine not
exceeding $1,000 if the person:

(1)     fails to comply promptly with process that the Legislative Auditor issues
under this Part III of this subtitle; or

(2)     violates any provision of § 2-1219(a) or § 2-1221 of this subtitle.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1996.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 364.

This bill establishes one vessel noise level measuring procedure and one maximum vessel
noise level limit for all State waters.

House Bill 848, which was passed by the General Assembly and signed by me on May 14,
1996, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 364.

AN ACT concerning

Operation of Boats - Noise Levels - All State Waters

FOR the purpose of establishing noise level requirements for the operation of vessels on
all waters of the State by eliminating the provisions limiting statutory noise levels
only to the nontidal waters of the State; eliminating a certain noise level as
measured in a certain manner; making the maximum noise level limit the same
regardless of the date certain engines are manufactured; requiring that noise levels
on all waters of the State be measured in a certain manner; providing for the
effective date of this Act; and generally relating to statutory noise levels on the
waters of the State.

BY repealing and reenacting, with amendments,
