(2) Each Grade A milk product container shall be marked as required by
rules and regulations adopted under this subtitle.
[(d) (1) (C) A Grade A milk product that is cooled to, packaged, and stored at
45 degrees Fahrenheit or less before it is purchased by or delivered to the ultimate
consumer has a sell-by period of 7 14 days.
[(2) If a scientific study justifies a modification of the temperature
requirements of this subsection, the Secretary, after a public hearing, may adopt rules and
regulations that modify the temperature requirements of this subsection.
(e) (1) A Grade A milk processor may apply for permission to extend the
sell-by period of a Grade A milk product by not more than 5 days.
(2) If an application under this subsection is supported by a scientific study
of shelf-life and the study is acceptable to the Secretary, the Secretary shall grant
permission to extend the sell-by period by not more than 5 days.]
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October June 1, 1996.

AN ACT concerning
Agency Regulations - Economic Impact on Small Businesses
FOR the purpose of requiring the Department of Fiscal Services to prepare an economic
impact analysis rating and an economic impact analysis concerning the effect of
certain regulations on small businesses under certain circumstances; requiring
certain agencies of the executive branch of State government to prepare an
economic impact analysis rating and an economic impact analysis under certain
circumstances; specifying the circumstances and procedures applicable to the
preparation and transmittal of economic impact analysis ratings and economic
impact analyses; specifying the legal effect of an economic impact analysis rating
and an economic impact analysis; requiring the Department of Fiscal Services to
keep copies of economic impact analysis ratings and economic impact analyses for a
certain period of time; providing that copies of economic impact analysis ratings and
economic impact analyses be reasonably available for public inspection; providing
that economic impact analysis ratings and economic impact analyses must be
published in the Maryland Register at a certain time; defining certain terms;
requiring a unit of the State or local government to provide certain information
upon a certain request; providing for a certain effective date; and generally relating
to the establishment of certain requirements to assess the economic impact of
certain regulations on small businesses.
