CHAPTER 605
(House Bill 150)

AN ACT concerning

State Police - Modified Workday

FOR the purpose of altering language relating to modified work schedules for certain
employees of the Department of State Police to conform with the federal Fair
Labor Standards Act
; and generally relating to modified work schedules and
alternative workdays of the State Police.

BY repealing and reenacting, with amendments,
Article 88B - Department of State Police
Section 23B

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 88B - Department of State Police

23B.

(a)     In this section, "nonexempt" means being entitled to pay for overtime work
under the federal Fair Labor Standards Act.

(b)     If authorized by the Secretary, a law-enforcement employee or a 40-hour
civilian employee of the Department shall work an alternative [10 hour] HOURLY
workday OF NOT MORE THAN 12 HOURS in lieu of an 8 hour workday.

(c)     Participants in the alternative modified workday program are entitled to
compensation in accordance with § 6-305 of the State Personnel and Pensions Article.
Personal leave for these employees shall be based on an 8-hour workday.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1996.
