(4) DISPOSITION OF NOT CRIMINALLY RESPONSIBLE.

(D)    "DEPARTMENT' MEANS THE DEPARTMENT OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES.                                                                                   

(E)     "DISCLOSURE STATEMENT" MEANS A SWORN STATEMENT OR
AFFIRMATION OF THE EXISTENCE OF A CRIMINAL CONVICTION OR PENDING
CRIMINAL CHARGES WITHOUT A FINAL DISPOSITION.

(F) "ELDERLY" MEANS AN INDIVIDUAL WHO:

(1) IS 55 YEARS OLD OR OLDER;

(2) LIVES IN A NURSING FACILITY; AND

(3) HAS A PHYSICAL OR MENTAL DISABILITY THAT REQUIRES
LONG
-TERM CARE.

(G) "EMPLOYEE" MEANS A PERSON WHO FOR COMPENSATION IS EMPLOYED
TO WORK IN A NURSING FACILITY AND WHO:

(1) CARES FOR OR SUPERVISES THE ELDERLY IN THE FACILITY; OR

(2) HAS ACCESS TO THE ELDERLY WHO ARE CARED FOR IN THE
FACILITY.

(II) "EMPLOYER" MEANS AN OWNER, OPERATOR, PROPRIETOR, OR MANAGER
OF A NURSING FACILITY.

(I) (1) "NURSING FACILITY" MEANS A FACILITY WHICH OFFERS NONACUTE
INPATIENT CARE TO PATIENTS SUFFERING FROM A DISEASE, CONDITION,
DISABILITY OF ADVANCED AGE, OR TERMINAL DISEASE REQUIRING MAXIMAL
NURSING CARE WITHOUT CONTINUOU
S HOSPITAL SERVICES AND WHO REQUIRE
MEDICAL SERVICES AND NURSING SERVICES RENDERED BY OR UNDER THE
SUPERVISION OF A LICENSED NURSE TOGETHER WITH CONVALESCENT SERVICES,
RESTORATIVE SERVICES, OR REHABILITATIVE SERVICES.

(2) "NURSING FACILITY" DOES NOT INCLUDE A FACILITY OFFERING
DOMICILIARY OR PERSONAL CARE AS DEFINED IN SUBTITLE 3 OF THIS TITLE.

(F) "POTENTIAL EMPLOYEE" MEANS AN INDIVIDUAL APPLYING FOR
EMPLOYMENT FOR COMPENSATION AT AN ADULT DEPENDENT CARE PROGRAM
AND WHOSE EMPLOYMENT WOULD INCLUDE CARING FOR OR SUPERVISING THE
DEPENDENT ADULTS IN THE PROGRAM.

(F) (1) "ELIGIBLE EMPLOYEE" MEANS AN INDIVIDUAL:

(I) WHO, FOR COMPENSATION WORKS FOR AN ADULT DEPENDENT
CARE PROGRAM;

(II) WHO HAS ROUTINE, DIRECT ACCESS TO DEPENDENT ADULTS IN
THE PROGRAM; AND
