AN ACT concerning
Employees' Retirement System - Reemployment of Retirees
FOR the purpose of requiring the Board of Trustees, at the option of certain retirees of
the Employees' Retirement System, to restore membership, stop payment of the
retirement allowance, restore previous service credit, and on payment of certain
amounts give credit for additional service if the retiree is reemployed in a
permanent position as a State employee; providing for a certain reduction in the
reemployed retiree's annuity and pension reserves under certain circumstances; and
generally relating to the reemployment of certain retirees of the Employees'
Retirement System.

Preamble
WHEREAS, Under Chapter 703, Acts of the General Assembly of 1994, provisions
of law were repealed that required a retiree of the Employees' Retirement System or of
several other State retirement and pension systems who was reemployed in a permanent
position with a participating employer to be restored to membership in the system that
was appropriate for the position; and
WHEREAS, Before the enactment of Chapter 703, a retiree of the Employees'
Retirement System had two years after retirement to be restored to active membership in
the System if employed by a participating employer and, thus, accrue additional service
credit in the System; and
WHEREAS, Those who retired before October 1, 1994, may have relied on the
provisions of law as they existed at the time of retirement in deciding to retire; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
