1996 LAWS OF MARYLAND

(II) BE MADE ONLY TO A PERSON THAT EXTENDS PROTECTION
NOT SUBSTANTIALLY LESS FAVORABLE AND EFFECTIVE THAN THAT PROVIDED BY
THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 509.

In subsection (a)(2)(i) and (ii) of this section, the reference to "regulations" is
substituted for the former reference to "rules". See the General Revisor's
Note to this article.

In subsection (a)(2)(i) of this section, the reference to "carry[ing] out" this
subtitle is substituted for the former reference to "effectuat[ing]" this subtitle
for consistency within this subtitle.

Also in subsection (a)(2)(i) of this section, the former reference to the
Corporation's failure "to submit a suitable plan of operation within 90 days
following July 1, 1971" is deleted as obsolete.

In subsection (e)(1), (2), and (3)(ii) of this section, the word "person" is
substituted for the former references to a "corporation", "association", or
"organization" because the defined term "person" includes a corporation,
association, or organization.

9-308. DUTIES AND POWERS OF COMMISSIONER; JUDICIAL REVIEW.

(A)     DUTIES OF COMMISSIONER.

THE COMMISSIONER:

' (1) SHALL NOTIFY THE CORPORATION OF THE EXISTENCE OF AN
INSOLVENT INSURER NOT LATER THAN 3 DAYS AFTER THE COMMISSIONER
RECEIVES NOTICE OF THE DETERMINATION OF INSOLVENCY; AND

(2) ON REQUEST OF THE BOARD OF DIRECTORS, SHALL PROVIDE THE
CORPORATION WITH A STATEMENT OF THE NET DIRECT WRITTEN PREMIUMS OF
EACH MEMBER INSURER.

(B)     POWERS OF COMMISSIONER.

(1) (I) THE COMMISSIONER MAY REQUIRE THAT THE CORPORATION
NOTIFY EACH INSURED, OR EACH PRINCIPAL AND SPECIFIC OBLIGEE NAMED IN A
SURETY BOND, OF EACH INSOLVENT INSURER AND ANY OTHER KNOWN
INTERESTED PARTY OF THE DETERMINATION OF INSOLVENCY AND OF THEIR
RIGHTS UNDER THIS SUBTITLE.
