display materials and installation services at charges, computed at not less than the fair
market value for these services. Any person violating any of the provisions of this section
shall, upon conviction, be punished by a fine of not more than $1,000 or by imprisonment
for not more than two years or by both fine and imprisonment in the discretion of the
court.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1996.

AN ACT concerning

Maryland-National Capital Park and Planning Commission - Montgomery County -

Zoning Regulations

PG/MC 8-96

FOR the purpose of providing that, in Montgomery County, the District Council in its
zoning regulations may require that a specified minimum number of votes is
required for the board of appeals to adopt certain zoning resolutions relating to
special exceptions; authorizing the Council to enact certain voting requirements for
certain uses; requiring the District Council to appoint a task force to evaluate
certain special exceptions in certain provisions of the Montgomery County Code;
providing for a delayed effective date for certain provisions of this Act; and making
stylistic changes.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 28 — Maryland-National Capital Park and Planning Commission

8-110.

(a) (1) A district council in either county, in its zoning regulations, may provide
that the board of zoning appeals, the district council, or an administrative office or agency
designated by the district council, in appropriate cases and subject to appropriate
principles, standards, rules, conditions, and safeguards set forth in the regulations, may
either grant or deny, upon conditions as may be deemed necessary to carry out the
