PARRIS N. GLENDENING, Governor                             Ch. 446

HOSPITAL, WHO IS LICENSED OR OTHERWISE AUTHORIZED TO PROVIDE HEALTH
CARE SERVICES WITHIN THE SCOPE OF THE LICENSE OR AUTHORIZATION IN:

(I) THE ORDINARY COURSE OF BUSINESS OR PRACTICE OF A
PROFESSION; OR

(II) AN APPROVED EDUCATION OR TRAINING PROGRAM.

(B)     WHENEVER AN INSURER OR NONPROFIT HEALTH SERVICE PLAN THAT
PROVIDES COVERAGE FOR HEALTH CARE SERVICES TO ANY GROUP OR
INDIVIDUAL ON AN EXPENSE-INCURRED BASIS UNDER A HEALTH INSURANCE
CONTRACT OR POLICY ISSUED OR DELIVERED IN THE STATE NEGOTIATES AND
ENTERS INTO A CONTRACT WITH PROVIDERS TO PROVIDE HEALTH CARE SERVICES
TO INSUREDS AT ALTERNATIVE RATES OF PAYMENT AND INSURED COPAYMENTS
COINSURANCE PAYMENTS ARE TO BE BASED ON A PERCENTAGE OF THE FEE FOR
HEALTH CARE SERVICES RENDERED BY A PROVIDER, THE INSURER OR NONPROFIT
HEALTH SERVICE PLAN SHALL CALCULATE THE AMOUNT OF THE COPAYMENT
COINSURANCE PAYMENT TO BE PAID BY THE INSURED EXCLUSIVELY FROM THE
NEGOTIATED ALTERNATIVE RATE FOR THE HEALTH CARE SERVICE RENDERED.

(C)     AN INSURER OR NONPROFIT HEALTH SERVICE PLAN MAY NOT CHARGE
OR COLLECT COPAYMENT COINSURANCE PAYMENT AMOUNTS FROM AN INSURED
GREATER THAN THOSE CALCULATED UNDER SUBSECTION (B) OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1996.

AN ACT concerning

Claims - Structured Settlements

FOR the purpose of authorizing the State to enter into a structured settlement of a claim
against the State; providing that the claimant shall select the investment company if
a structured settlement is entered into; defining a term; and generally relating to
structured settlements and claims filed against the State.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
