TITLE 2. STATE EMPLOYMENT GENERALLY.

SUBTITLE 1. GENERAL PROVISION.

2-101.

EXCEPT AS EXPRESSLY PROVIDED BY LAW, THIS TITLE DOES NOT LIMIT ANY
EXPRESS OR IMPLIED MANAGEMENT PREROGATIVE OR OTHER AUTHORITY
BELONGING TO AN APPOINTING AUTHORITY AND MANAGEMENT.

SUBTITLE 2. PERSONNEL SYSTEMS IN STATE GOVERNMENT.
2-201.

EXCEPT AS OTHERWISE PROVIDED BY LAW, AN EMPLOYEE IN THE JUDICIAL,
LEGISLATIVE, OR EXECUTIVE BRANCH OF STATE GOVERNMENT IS GOVERNED BY
THE LAWS AND PERSONNEL POLICIES AND PROCEDURES APPLICABLE IN THAT
BRANCH.

2-202.

(A)    THE PRINCIPAL PERSONNEL SYSTEM IN THE EXECUTIVE BRANCH OF
STATE GOVERNMENT IS THE STATE PERSONNEL MANAGEMENT SYSTEM

(B)     AS EXPRESSLY AUTHORIZED BY LAW, A UNIT IN THE EXECUTIVE BRANCH
OF STATE GOVERNMENT MAY ESTABLISH A PERSONNEL SYSTEM THAT OPERATES
INDEPENDENTLY OF THE STATE PERSONNEL MANAGEMENT SYSTEM

SUBTITLE 3. STATE EMPLOYMENT POLICIES.

2-301.

(A) IN KEEPING WITH STATE EFFORTS TO REINVENT GOVERNMENT,
RESTRUCTURING OF THE STATE'S PERSONNEL SYSTEM SHOULD ENHANCE THE
DELIVERY OF SERVICES TO CITIZENS IN AN EFFECTIVE AND TIMELY MANNER.

(B) TO MAINTAIN EFFICIENT AND EFFECTIVE OPERATIONS OF STATE
GOVERNMENT, EACH STATE EMPLOYEE:

(1)     SHALL BE TREATED WITH FAIRNESS IN STATE EMPLOYMENT;

(2)     MAY PARTICIPATE IN THE STATE HEALTH AND WELFARE BENEFITS
PROGRAM IN ACCORDANCE WITH SUBTITLE 5 OF THIS TITLE;

(3)     MAY PARTICIPATE IN THE STATE RETIREMENT AND PENSIONS
SYSTEMS IN ACCORDANCE WITH DIVISION II OF THIS ARTICLE;

(4)     SUBJECT TO TITLE 9, SUBTITLE 6 OF THIS ARTICLE, MAY
PARTICIPATE IN THE STATE EMPLOYEES' LEAVE BANK AND THE
EMPLOYEE-TO-EMPLOYEE LEAVE DONATION PROGRAM;

(5)     WHO TRANSFERS TO A POSITION IN ANY UNIT OF STATE
GOVERNMENT, REGARDLESS OF THE PERSONNEL SYSTEM GOVERNING THE
