(3)     The monthly issuance of a list of all State publications that have been
received by the Center. This list shall be sent to all depository libraries and to others upon
request and the Center may provide for subscription services; AND

(4)     Making determinations on exemptions of State publications from the
depository requirements of this subtitle[; and

(5)     The implementation of rules and policies promulgated by the
Commission on the State Publications Depository and Distribution Program].

(c)     The Administrator of the Program shall be appointed by the Director of the
State Library Resource Center [with the approval of the Commission on the State
Publications Depository and Distribution Program].

(d)     Funding for the Program shall be provided in the aid to education budget of
the State Board of Education in a program entitled State Publications Depository.

[23-2A-03.

(a)     There is established a Commission on the State Publications Depository and
Distribution Program.

(b)     The Commission shall have 9 members appointed by the Governor as follows:

(1)     3 members representing depository libraries;

(2)     3 members representing State agencies; and

(3)     3 members from the general public.

(c)     (1) Each member shall serve for a term of 4 years and until a successor is
appointed and qualifies and may not serve more than 2 consecutive 4 year terms.

(2) These terms shall be staggered as required for the original appointments
to the Commission.

(d)     Each member of the Commission shall serve without compensation, but shall
be reimbursed for expenses incurred while engaged in the performance of duties, in
accordance with Standard State Travel Regulations.

(e)     The Commission:

(1)     Shall elect 1 of its members as its chair each year;

(2)     May elect other officers as needed; and

(3)     Shall meet at least quarterly.

(f)     The Commission shall:

(1)     Promote the effective dissemination and the use of State publications;

(2)     Provide for the granting of depository status to geographically dispersed
libraries, other than those listed in § 23-2A-01(3);
