(3) A financial institution may not be approved as custodian for the
collateral of a depositary unless the assets of the financial institution equal or exceed
200% of the value of the collateral to be held for the depositary.

(a)     (3) Each banking institution that is a depositary for State money shall
submit to the [ Bank] Commissioner OF FINANCIAL REGULATION each report for which
the Commissioner asks.

(b)     Except as otherwise provided in subsection (e) of this section, on or before
July 1, 1991, an evaluation shall be made of the following governmental activities or units
