(ii) The amount equal to one half of the total user fees times the ratio
of gross operating revenue of each facility to total gross operating revenues of all
facilities;

(2)     Establish minimum and maximum assessments; and

(3)     Assess each facility on or before June 30 of each fiscal year.

[(d)](E) On or before September 1 of each year, each facility assessed under this
section shall make payment to the Commission. The Commission shall make provisions
for partial payments.

[(e)](F) Any bill not paid within 30 days of the agreed payment date may be
subject to an interest penalty to be determined by the Commission.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1,1996. It shall remain in effect for a period of 7 years and, at the end of July 1, 2003;
with no further action required by the General Assembly, the Act shall be abrogated and
of no further force and effect.

(House Bill 799)

AN ACT concerning

State Highways - Sidewalks - Funding to Local Governments

FOR the purpose of clarifying the definition of "urban highway" for the purposes of
sidewalk construction; authorizing State funding of certain sidewalk projects in
certain designated areas without a matching contribution from a local government;
requiring local governments to provide for certain rights-of-way, public notice, and
opportunities for community involvement when requesting certain projects; and
generally relating to the construction of sidewalks in response to a request from a
local government.

BY repealing and reenacting, with amendments,

Preamble

WHEREAS, Legislation entitled "Bicycle and Pedestrian Access 2000" was
enacted in 1995 and states a goal of significantly increasing the percentage of total trips
performed by walking or bicycling by Fiscal Year 2000; and
