Ch. 111                                    1996 LAWS OF MARYLAND

(iii) The project is approved by local planning and zoning authorities;

(iv) The project is located in an intensely developed area, as
designated in programs adopted or approved by the Chesapeake Bay Critical Area
Commission under Title 8, Subtitle 18 of the Natural Resources Article; and

(v) The project allows public access to tidal waters, if appropriate.

Article - Natural Resources

8-1808.4.

(a) This section does not apply to any project involving the construction of a dwelling
unit or other non-water dependent structure on a pier located on State or private wetlands
within the Critical Area in:

(1) Prince George's County; OR

(2) CECIL COUNTY ON THE CHESAPEAKE AND DELAWARE CANAL IF THE
APPLICANT DEMONSTRATES TO THE SECRETARY THAT THE PIER ON WHICH A
DWELLING UNIT OR OTHER NON-WATER DEPENDENT STRUCTURE IS PROPOSED IS
APPURTENANT TO A PARCEL ON WHICH THERE EXISTED, AS OF JANUARY 1, 1966, USES OR
STRUCTURES WHICH WERE SUBSEQUENTLY REMOVED AS A RESULT OF
FEDERALLY-REQUIRED WIDENING OR MAINTENANCE ACTIVITIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1996. It shall remain effective for a period of 1 year and, at the end of
September 30, 1997, with no further action required by the General Assembly, this Act
shall be abrogated and of no further force and effect.

(Senate Bill 138)

AN ACT concerning

Tort Reform - Reporting Requirements

FOR the purpose of extending the termination date of certain provisions of law that
require insurers providing professional liability insurance to health care providers in
the State to submit certain information to the Insurance Commissioner, authorize
the Insurance Commissioner to require certain insurers to submit certain reports,
and require the Insurance Commissioner to submit a certain report to the
Legislative Policy Committee by a certain date each year; and altering the contents
of the Commissioner's report.

BY repealing and reenacting, with amendments,

Chapter 639 of the Acts of the General Assembly of 1986
