Ch. 71

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:

(1)     Subject to the provisions of paragraph (2) of this section, the special taxing
area or district created by Chapter 117 of the Acts of 1924, as amended by Chapter 558 of
the Acts of 1951, Chapter 175 of the Acts of 1991 (codified as Chapter 69 of Article 16 -
Montgomery County of the Code of Public Local Laws of Maryland) and Chapter 45 of
the Acts of 1994, and known as the Village of North Chevy Chase, Montgomery County,
Maryland, shall be abolished in its entirety, and Chapter 117 of the Acts of 1924, as
amended, shall be repealed effective the time that the area becomes a municipal
corporation under Article XI-E of the Constitution of Maryland.

(2)     Any contract, obligation, duty, liability, or penalty outstanding on behalf of the
special taxing area or district at the time it becomes a municipal corporation and any
right, privilege, asset, property or interest in property, claim, demand, or cause of action
of the special taxing district or area at the time it becomes a municipal corporation shall
be fully assumed by the municipal corporation.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 69-1 through
69-8, inclusive, and the chapter heading "Chapter 69. North Chevy Chase" of Article 16
- Montgomery County of the Code of Public Local Laws of Maryland be repealed.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall be construed
retroactively and shall be applied to and interpreted to apply as of the date of
incorporation under Article XI-E of the Constitution of Maryland and Article 23A -
Corporations - Municipal of the Annotated Code of Maryland.

SECTION 4. AND BE IT FURTHER ENACTED, That, subject to the provisions
of Section 3 of this Act, this Act shall take effect June 1, 1996.
