UNDER TITLE 10, SUBTITLE 2 OF THE STATE GOVERNMENT ARTICLE

11.

(A)    IF A DOCUMENT PRESENTED FOR NOTARIZATION DOES NOT CONTAIN A
NOTARIAL CERTIFICATE REFLECTING THE TAKING OF AN OATH OR
ACKNOWLEDGMENT, A NOTARY MAY NEVERTHELESS WITNESS THE SIGNING OF
THE DOCUMENT IN THE NOTARY'S OFFICIAL CAPACITY, IN ACCORDANCE WITH
SUBSECTION (B) OF THIS SECTION.

(B)     A NOTARY ACTING AS A WITNESS IN THE NOTARY'S OFFICIAL CAPACITY
UNDER SUBSECTION (A) OF THIS SECTION SHALL:

(1)     OBTAIN SATISFACTORY PROOF OF THE IDENTIFY IDENTITY OF THE
PERSON SIGNING THE DOCUMENT;

(2)     OBSERVE THE SIGNING OF THE DOCUMENT;

(3)     DATE, SIGN, AND SEAL OR STAMP THE DOCUMENT; AND

(4)     RECORD THE ACT IN THE NOTARY'S FAIR REGISTER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1996.

(Senate Bill 120)

AN ACT concerning

Crimes - Inhalants - Nitrons Oxide

FOR the purpose of including nitrous oxide in the list of inhalants and noxious substances
that may not be smelled or inhaled; clarifying that the prohibition pertains to any
substance or chemical that contains, wholly or in part, certain substances; expanding
the prohibition on distributing certain inhalants and noxious substances to minors to
apply also to distribution to adults; making this act an emergency measure; and
generally relating to inhalants and nitrous oxide.

BY repealing and reenacting, with amendments,
Article 27 - Crimes and Punishments
Section 301 and 301A
Annotated Code of Maryland
(1992 Replacement Volume and 1995 Supplement)
