In subsection (a)(1) of this section, the former reference to the transaction of
surplus lines insurance "as authorized in Subtitle 13" is deleted as implicit in
the reference to the "lawful" transaction of such insurance.

In subsection (c)(2) of this section, the references to the surety "insurer" are
added for clarity.

In subsection (c)(4) of this section, the former phrase "any part thereof
which modified "insurance", is deleted as surplusage.

In subsection (c)(8) of this section, the reference to statutes "relating to
insurance" is added for clarity.

Subsection (c)(9) of this section is revised to reflect the Insurance Article
Review Committee's understanding of the former law.

In subsection (c)(6)(iv) and (viii) of this section, the references to an
"insurance" contract are added for clarity. Similarly, in subsection (c)(6)(ix) of
this section, the reference to insurance "business" is added for clarity and to
use the defined term.

4-206. SERVICE OF PROCESS ON COMMISSIONER.

(A) COMMISSIONER DEEMED ATTORNEY OF UNAUTHORIZED INSURER.

AN UNAUTHORIZED FOREIGN INSURER OR UNAUTHORIZED ALIEN INSURER IS
DEEMED TO HAVE APPOINTED THE COMMISSIONER TO BE THE ATTORNEY OF THE
UNAUTHORIZED INSURER FOR PURPOSES OF SERVICE OF PROCESS IN A
PROCEEDING INSTITUTED BY OR FOR AN INSURED OR BENEFICIARY ARISING OUT
OF AN INSURANCE CONTRACT AND TO HAVE AGREED THAT SERVICE ON THE
COMMISSIONER HAS THE SAME LEGAL EFFECT AS PERSONAL SERVICE IN THE STATE
ON THE UNAUTHORIZED INSURER, IF THE UNAUTHORIZED INSURER IN THE STATE,
BY MAIL OR OTHERWISE:

(1)     ISSUES OR DELIVERS INSURANCE CONTRACTS TO RESIDENTS OF
THE STATE OR CORPORATIONS AUTHORIZED TO DO BUSINESS IN THE STATE;

(2)     SOLICITS APPLICATIONS FOR INSURANCE CONTRACTS;
