(3) PAYS TO THE COMMISSIONER THE APPROPRIATE RENEWAL FEE
REQUIRED BY § 2-112 OF THIS ARTICLE.
(D) ISSUANCE OF RENEWAL; PAYMENT OF RENEWAL FEE.
(1) THE COMMISSIONER SHALL RENEW THE CERTIFICATE OF
AUTHORITY OF EACH HOLDER WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.
(2) IF A CERTIFICATE HOLDER PAYS THE APPLICABLE RENEWAL FEE
BEFORE THE CERTIFICATE OF AUTHORITY EXPIRES, THE CERTIFICATE OF
AUTHORITY REMAINS IN EFFECT UNTIL THE COMMISSIONER RENEWS OR REFUSES
TO RENEW THE CERTIFICATE OF AUTHORITY.
REVISOR'S NOTE: Subsections (a) and (d)(2) of this section are new language
derived without substantive change from former Art. 48A, § 54.
Subsection (b) of this section is standard language added to conform to
current practice of the Commissioner and to similar provisions governing
other State-regulated businesses.
Subsection (c)(1) of this section is new language added to state expressly that
which only was implied in the former law, i.e., that to renew a certificate of
authority the holder must otherwise be entitled to the certificate of authority.
Subsection (c)(2) of this section is standard language added to state expressly
that which only was implied in the former law, i.e., renewal application may be
made only on the form provided by the Commissioner.
Subsection (c)(3) of this section is new language added to provide a
convenient cross-reference to the provisions on renewal fees.
Subsection (d)(1) of this section is standard language added to state expressly
that which only was implied in the former law, i.e., the Commissioner has a
duty to renew the certificate of authority of a qualified holder.
In subsection (a) of this section, the words "original and renewal", which
formerly modified "certificate of authority", are deleted as unnecessary since,
absent a limitation, the reference to a "certificate of authority" includes both
original and renewal certificates of authority.
Also in subsection (a) of this section, the phrase "heretofore or hereafter
issued to insurers", which formerly modified "certificate of authority", is
deleted as surplusage.
Also in subsection (a) of this section, the former phrase "unless previously
suspended or revoked" is deleted as unnecessary. A certificate of authority
that has been suspended or revoked is not in effect and therefore cannot be
renewed.
