(a)     Any record or file associated with a chart review conducted under the
provisions of [Article 49D, § 34 of the Code] § 34 OF THIS SUBTITLE are confidential
and are not discoverable and are not admissible in evidence in any civil action arising out
of matters that are being reviewed and evaluated by the State Commission on Infant
Mortality.

(b)     The Director shall:

(1)     Utilize the services of the staff within the Office [of] FOR Children,
Youth, and Families; and

(2)     Subject to the advice and consent of the Chairman of the Commission
and as provided in the State budget, contract for the professional services necessary to
carry out the duties of the Commission.

(c)     "Family preservation services" [mean] MEANS State, local, or private agency
services and assistance designed:

(1)     To allow children to remain safely with their families and to prevent
out-of-home placements by assisting families to address the circumstances or conditions
which may cause out-of-home placements and to care for their children; or

(2)     To allow children to return safely to their families from out-of-home
placements and to assist families to address circumstances or conditions which caused
out-of-home placements and to care for their children.
