In subsection (g)(2) of this section, the reference to "certified copies of all
documents" is substituted for the former reference to "a full and complete
transcript, duly certified by him, of all documents" for clarity and to reflect the
Insurance Article Review Committee's understanding of the intended
meaning of the provision.
In subsection (j)(l) of this section, the reference to the "circuit court" is
substituted for the former reference to the "Circuit Court for Baltimore City
or circuit court of the county" for brevity.
The Insurance Article Review Committee notes, for consideration by the
General Assembly, that subsection (c)(2) of this section does not apply to the
suspension or revocation of the certificate of qualification of a managing
general agent. Managing general agents were required to obtain a certificate
of qualification by Ch. 268, Acts of 1991. The failure to add a reference to
appeals by managing general agents appears to have been inadvertent and the
General Assembly may wish to consider adding the reference to subsection
(c)(2) of this section.
The Committee also notes, for consideration by the General Assembly, that
the Commissioner finds the 30-day deadline for filing a transcript with a court
in which an appeal is pending to be unworkable. In practice, it takes the
Commissioner up to 60 days to file the transcript because of the amount of
time that it takes to have a transcript prepared. The Commissioner
recommends that the deadline be extended to reflect the actual time required
to file a transcript.
