1995 LAWS OF MARYLAND

ANY REGULATIONS ADOPTED UNDER THIS SECTION SHALL ESTABLISH A
SUITABLE MEANS FOR PAYMENT IN IMMEDIATELY AVAILABLE FUNDS TO ENSURE
THE AVAILABILITY OF THOSE FUNDS TO THE STATE ON THE DATE THAT PAYMENT
IS DUE.

change from former Art. 48A, § 41A.

2-114. DISPOSITION OF MONEY.

(A)     IN GENERAL..                                                                  

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, THE
COMMISSIONER SHALL PAY ALL MONEY COLLECTED UNDER THIS ARTICLE INTO
THE GENERAL FUND OF THE STATE.

(B)      EXCEPTION.

THE COMMISSIONER SHALL PAY ALL MONEY COLLECTED FOR TRAVEL
EXPENSES AND LIVING EXPENSE ALLOWANCE UNDER § 2-208(1) OF THIS ARTICLE
INTO A SPECIAL REVOLVING FUND HELD BY THE COMPTROLLER FOR THE SOLE
PURPOSE OF PAYING THE COSTS OF EXAMINATIONS OF INSURERS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 33A.

In subsection (a) of this section, the former references to "§§ 33(i), 41(1), (2),
(3), (4), and (16), and 194 [of Art. 48A]" are deleted. The former references
were unnecessary because, except as provided in subsection (b) of this section,
all money collected under this article is paid into the General Fund. The
former references also were potentially misleading because not all of the
provisions of this article under which money is collected were listed, raising
questions about whether money collected under a provision not listed is paid
into the General Fund.

SUBTITLE 2. ENFORCEMENT.
2-201. ENFORCEMENT OF ARTICLE.

(A)     IN GENERAL:

THE COMMISSIONER MAY BRING AN ACTION IN A COURT OF COMPETENT
JURISDICTION TO ENFORCE THIS ARTICLE OR AN ORDER ISSUED BY THE
COMMISSIONER UNDER THIS ARTICLE.

(B)     LEGAL REPRESENTATION.
