legislative auditors of the Department of Fiscal Services. The General
Assembly may wish to clarify whether the auditor and examiner is intended to
be one individual or two individuals and to clarify the duties of the auditor and
examiner.

As to other provisions on bonding of officers and employees of the State, see
Art. 19, § 20 of the Code, which requires the bonds of all officers and
employees of the State to be made to the State and, except for the bond of the
State Comptroller, to be filed with the State Comptroller, and SF § 10-203,
which authorizes the Board of Public Works to adopt regulations setting the
terms and renewal of bonds of State officials and employees. See also SF §
9-107, which provides for payment of losses covered by the State Insurance
Program, including loss as a result of a settlement or judgment against State
personnel.

2-105. UNCLASSIFIED EMPLOYEES.

(A)     "SECRETARY" DEFINED.

IN THIS SECTION, "SECRETARY" MEANS THE SECRETARY OF PERSONNEL.

(B)     MANAGEMENT, TECHNICAL, OR PROFESSIONAL EMPLOYEES.

ALL EMPLOYEES OF THE ADMINISTRATION THAT SERVE IN A MANAGEMENT,
PROFESSIONAL, OR TECHNICAL CAPACITY ARE IN THE UNCLASSIFIED SERVICE OF
THE STATE PERSONNEL MANAGEMENT SYSTEM AND SERVE AT THE PLEASURE OF
THE COMMISSIONER.

(C)     COMPENSATION.

THE COMPENSATION OF UNCLASSIFIED PERSONNEL SHALL BE DETERMINED
BY THE COMMISSIONER AND IF POSSIBLE, IN ACCORDANCE WITH THE STATE PAY
PLAN.

(D)     SUBMISSION OF CHANGES TO SECRETARY.

(1)      AT LEAST 45 DAYS BEFORE THE EFFECTIVE DATE OF THE CHANGE,
THE COMMISSIONER SHALL SUBMIT TO THE SECRETARY EACH CHANGE TO SALARY
PLANS THAT INVOLVE INCREASES OR DECREASES IN SALARY RANGES OTHER THAN
THOSE ASSOCIATED WITH ROUTINE RECLASSIFICATIONS AND PROMOTIONS OR
GENERAL SALARY INCREASES APPROVED BY THE GENERAL ASSEMBLY.

(2)      REPORTABLE CHANGES INCLUDE CREATION OR ABOLITION OF
CLASSES, REGRADING THE CLASSES FROM ONE ESTABLISHED RANGE TO ANOTHER,
OR CREATION OF NEW PAY SCHEDULES OR RANGES.

(3)      THE SECRETARY SHALL:
