AN ACT concerning

Frederick County - Right to Farm Law

FOR the purpose of authorizing the County Commissioners of Frederick County to adopt
ordinances or regulations and take other action to protect a person's right to engage
in agricultural and forestry operations; and requiring that before the adoption of an
ordinance or regulations by the County Commissioners, the County Commissioners
hold a public hearing following reasonable notice procedures.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 11 - Frederick County

2-2-3.

(A)     SUBJECT TO SUBSECTION (B) OF THIS SECTION,. THE COUNTY
COMMISSIONERS MAY ADOPT AN ORDINANCE OR REGULATIONS, OR TAKE ANY
OTHER ACTION THAT THE COUNTY COMMISSIONERS CONSIDER NECESSARY, TO
PROTECT A PERSON'S RIGHT TO FARM OR ENGAGE IN AGRICULTURAL OR
FORESTRY OPERATIONS.

(B)     BEFORE ADOPTING AN ORDINANCE OR REGULATIONS UNDER THIS
SECTION, THE COUNTY COMMISSIONERS SHALL HOLD A PUBLIC HEARING AND
SHALL PROVIDE REASONABLE NOTICE OF THE HEARING.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.
