Article 38A - Fires and Investigations

17.

(a)     Any person possessing or discharging fireworks in violation of this subtitle is
guilty of a misdemeanor and upon conviction shall be punished for each offense by a fine
of not more than [$250.00] $250. Any person selling fireworks in violation of this subtitle
is guilty of a misdemeanor and upon conviction shall be punished for each offense by a
fine of not more than [$1000.00] $1,000.

(b)     The authority for the administration of this section is vested in the State Fire
Prevention Commission and the authority for the enforcement of this section is vested in
the State Fire Marshal. The State Fire Marshal shall enforce the provisions of this section
and the rules and regulations adopted by the State Fire PREVENTION Commission so that
persons on the premises are reasonably protected in the event of an emergency.

(d) The rules and regulations shall include, but are not limited to, the following
requirements:

(2) Emergency electrical power sufficient to operate elevators and electrical
facilities in hospital operating rooms, hospital [X-rays] X-RAY EQUIPMENT, and other
emergency equipment necessary to the proper operation of medical services in hospitals
and nursing homes is required. The Secretary of Health and Mental Hygiene shall be
consulted as to the requirements that should be made in the operations of hospitals and
nursing homes. In making this evaluation, the Secretary shall consider the size and nature
of the particular hospital or nursing home operation.

(a)     (2) "[Barbeque] BARBECUE grill" means equipment used for outdoor
cooking that uses electricity or the burning of charcoal, liquid propane gas, or other fuel
for its heat source.

(b)     In Charles County, a person may not use a [barbeque] BARBECUE grill for
outdoor cooking:

(1) On a balcony of a residential dwelling; and
