(3) SUBJECT TO CONDITIONS ESTABLISHED BY THE SECRETARY, A
JUVENILE WHO MOVES OUT OF A COUNTY PARTICIPATING IN THE PILOT PROGRAM
SHALL REMAIN SUBJECT TO THE REQUIREMENTS OF THE PILOT PROGRAM.
(4) LAW ENFORCEMENT AGENCIES IN JURISDICTIONS WHERE THE
PILOT PROGRAM IS OPERATING SHALL COOPERATE WITH THE DEPARTMENT AND
COMPLY WITH ANY REGULATIONS ISSUED BY THE DEPARTMENT TO IMPLEMENT
THIS SECTION.
(C) (1) IF A LAW ENFORCEMENT OFFICER AUTHORIZED TO MAKE ARRESTS
HAS PROBABLE CAUSE TO BELIEVE THAT A CHILD HAS COMMITTED AN ACT WHICH,
IF COMMITTED BY AN ADULT WOULD BE A MISDEMEANOR, THE OFFICER MAY:
(I) ISSUE A CITATION UNDER THIS SECTION; OR
(II) FILE A COMPLAINT UNDER § 3-810 OF THIS ARTICLE.
(2) A LAW ENFORCEMENT OFFICER MAY NOT ISSUE A CITATION TO A
CHILD WHO HAS COMMITTED AN ACT WHICH, IF COMMITTED BY AN ADULT, WOULD
BE:
(I) A FELONY; OR
(II) A VIOLATION OF ARTICLE 27, § 36B OF THE CODE.
(D) (1) CITATIONS ISSUED UNDER THIS SECTION SHALL BE IN A FORMAT
PRESCRIBED BY THE SECRETARY AFTER CONSULTING WITH LAW ENFORCEMENT
OFFICIALS.
(2) CITATION FORMS SHALL BE PRINTED BY LAW ENFORCEMENT
AGENCIES.
(3) CITATIONS SHALL CONTAIN:
(I) THE NAME, ADDRESS, AND BIRTH DATE OF THE CHILD;
(II) THE NAME, ADDRESS, AND TELEPHONE NUMBER OF THE
CHILD'S PARENT OR LEGAL GUARDIAN;
(III) THE TIME, PLACE, AND DATE OF THE OFFENSE;
(IV) A DESCRIPTION OF THE NATURE OF THE OFFENSE, INCLUDING
ANY STATUTE ALLEGEDLY VIOLATED;
(V) THE DATE AND TIME WHEN AND THE LOCATION WHERE THE
CHILD MUST APPEAR BEFORE A COMMUNITY SERVICE COORDINATOR; AND
(VI) A DESCRIPTION OF THE COMMUNITY SERVICE REQUIREMENTS
WHICH MAY BE IMPOSED.
(4) CITATIONS SHALL BE SIGNED BY THE ISSUING OFFICER AND THE
CHILD, AND SHALL CONTAIN SUCH OTHER INFORMATION AS PRESCRIBED BY THE
DEPARTMENT'S REGULATIONS.
