waiver(s) is submitted to the Legislative
Policy Committee. The Legislative Policy
Committee shall have 45 days to review and
comment on the plan before it becomes
effective Further provided that state general
funds appropriated for Medical Care
Provider Reimbursements for out-of-state
placement of children may be used by the
Local Management Boards to assist in
returning children from out-of-state
placements. It is the intent of the General
Assembly that the funds travel with the
child from the out-of-state placement to an

Medical Care Provider Reimbursements -
32.17.01.03 are to be used only for the
purposes herein appropriated, and there
shall be no budgetary transfer to any other
program or purpose, except that funds may
be transferred for the purpose of providing
medical coverage for the population served
by the PALP - Primary Care Services
program. No funding may be transferred to
the PALP - Primary Care Services
program, until the budget committees are
notified in writing of the intent to transfer
and 30 days have elapsed from the date on
which this notification is received.
Further, it is the intent of the General
Assembly that the Medical Care Provider
Reimbursements appropriation be
expended in accordance with the budget
detail presented to and approved by the
General Assembly. Should the department
wish to make a regulatory, policy, or
procedural change which has an increase or
decrease greater than $300,000 on the
program's budget, whether or not the
increase or decrease is offset in whole or in
part by other action, it shall inform the
budget committees of the change, and the
